By downloading, installing, or using the SB Audio FX mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our App.

2. Description of Service

SB Audio FX is a professional DJ sound effects application designed for iPad users. The App allows you to trigger sound effects, import custom sounds, create playlists, and enhance your DJ performances with professional audio tools.

3. User Accounts and Registration

To access certain features of the App, you may need to create an account or join our waitlist. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information
  • Keep your account credentials secure
  • Accept responsibility for all activities under your account

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App for any illegal or unauthorized purpose
  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Upload or import copyrighted material without permission
  • Attempt to reverse engineer, decompile, or modify the App
  • Use the App to create content that is harmful, offensive, or inappropriate
  • Interfere with or disrupt the App's functionality

5. Intellectual Property Rights

The App, including its design, code, graphics, and content, is owned by SB Audio FX and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved.

5.2 Your Content

You retain ownership of any content you import or create using the App. By using the App, you grant us a limited license to process and store your content solely for the purpose of providing the App's functionality.

5.3 Third-Party Content

The App may include third-party content, such as sound effects and music. You are responsible for ensuring you have the necessary rights to use such content in your performances.

6. Privacy and Data Protection

7. App Updates and Modifications

8. Disclaimers and Limitations

The App is provided "as is" and "as available." We do not guarantee that the App will be uninterrupted, error-free, or secure. We are not responsible for any technical issues or service interruptions.

8.2 Limitation of Liability

To the maximum extent permitted by law, SB Audio FX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use.

9. Indemnification

You agree to indemnify and hold harmless SB Audio FX, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

10. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will cease immediately, and we may delete your account and data.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SB Audio FX operates, without regard to its conflict of law provisions.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless prohibited by law.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SB Audio FX regarding the use of the App and supersede all prior agreements and understandings.
